The European Union Agency for the Cooperation of Energy Regulators (ACER) has recently launched a public consultation on the update of its cross-border cost allocation (CBCA) Recommendation. This move follows the mandate set by Regulation (EU) 2022/869 on guidelines for trans-European energy infrastructure, which requires ACER to identify best practices for treating investment requests for projects of common interest (PCIs).
The updated CBCA Recommendation aims to incorporate the revised (TEN-E) provisions and learnings from the latest cross-border cost allocation investment requests.
ACER is inviting all interested stakeholders to participate in the public consultation, which started on 23 February and will continue until 31 March 2023. The consultation covers various topics, including the scope of the recommendation, the role of scenarios and cost-benefit analysis, the allocation and compensation mechanism, and cross-border cost allocation for offshore projects.
ACER will evaluate all feedback and comments received during the public consultation and take them into account when drafting the document. The updated CBCA Recommendation is expected to be adopted by 24 June 2023.
