DESCRIPTION OF ADMINISTRATIVE SERVICE PROVISION

OF THE NATIONAL ENERGY REGULATORY COUNCIL

 

LICENSING OF LIQUEFIED NATURAL GAS (LNG) REGASIFICATION ACTIVITIES

The application form is approved by the Resolution No O3-400 of the National Control Commission for Prices and Energy of 30 November 2011 "On the Approval of the Form of the Application on Issuing, Changing, Amending a Licence, Issuing a Duplicate of the Licence, Suspending the Validity of a Licence, Annulling the Suspension of Validity of a Licence".

Duration of the service provision

Within 30 days of the receipt of the necessary documents, the Council shall issue or change the licence or provide a reasoned written refusal to do so to the applying company. If not all data or documents are submitted, the time limit is counted from the date of submission of all data or documents.

5.

Price of the service

According to the list of specific state fee rates approved by the Resolution No 1458 of the Government of the Republic of Lithuania of 15 December 2000 "On the Approval of the Specific State Fee Rates and the Rules on Payment and Refund", the fixed state fee rates are paid:

Issue of the licence: EUR 579;

Change of the licence: EUR 289;

Issue of a duplicate: EUR 43;

Amendment of the licence: EUR 43.

Methods and procedures of payment for the service (also including the payment possibility for foreigners)

The state fee is paid to the budget revenue collection accounts of the State Tax Inspectorate under the Ministry of Finance. The payment code for services provided by the Council: 5774.

7.

Description of the service provision process

A liquefied natural gas (LNG) regasification license shall entitle the holder to engage in LNG regasification activities, i.e. the reception, storage and transformation of LNG at the LNG terminal for subsequent delivery to the transmission system. Persons seeking to obtain a license must operate the LNG system that is connected to an existing transmission system and established in accordance with the requirements of legislation by the right of ownership or on other legal grounds.

A company, wishing to obtain a licence, shall submit an application in the established form and required documents to the National Energy Regulatory Council (hereinafter – the Council). Following the receipt of documents indicated in this chapter, the Council checks whether these documents and information contained therein comply with the licensing condition (technological, financial and managerial capacities of the company) and decides on the issue of the licence.

Information and documents to be provided by the person

The applicant shall submit an application in the established form and the following documents confirming the compliance of the applicant with the requirements of the legislation to the Council:

 

1. Documents indicated in the description of the assessment procedures of technological, financial and managerial capabilities of entities approved by the Resolution No O3-6 of the Commission of 29 January 2009 "On the Approval of the Description of the Procedure of Assessment of Technological, Financial and Managerial Capabilities of Energy Companies".

 

2.Copies of the documents of the establishment, copies of the articles of association, authenticated by stamp, if it mandatory to have them, and by the signature of the manager;  the list of groups with which the legal person seeking to engage in licensed transmission activities in the gas sector is consolidated in accordance with international accounting standards (for each of these groups, a list of companies engaged in at least one of the following activities: gas supply, production and electricity supply, members of the board of these companies);

2.3. the decision (with the voting documents) made by the meeting of the members or the collegial body of the legal person in question, upon which the collegial body members of the legal person in question are appointed; 

2.4 the decision made by the meeting of the members or the collegial body of the legal person in question, upon which the collegial body members of the legal person in question are appointed; 

2.5 all the rules and procedures under which the governing bodies representing the legal person operate; 

 2.6 the list of the members of the collegial body, the information about the manager and other entities legally representing the legal person in question (for each of them, a description and declaration of their other professional activities, certifying that they are not the members of the collegial body of the legal person in question or the manager of the company engaged in the activities of natural gas supply, production and transmission).

4. A person seeking to engage in licensed distribution activities in the gas sector (for an integrated gas company) and distributing to less than 100,000 costumers, the requirements determined in points 2.2–2.6 shall not apply.

Appeal procedure against actions (inactions) of the service provider

The decisions of the Council shall be appealed in accordance with procedures and conditions laid down by the Law on Administrative Proceedings of the Republic of Lithuania.

Licensing rules on the issue of permissions for natural gas transmission, distribution, storage, liquefaction, supply and market operator approved by the Resolution No 1246 of the Government of the Republic of Lithuania of 27 October 2011  "On the Approval of the Licencing Rules on Transmission, Distribution, Storage, Liquefaction, Supply and Market Operator of Natural Gas";

4. Description of the assessment procedures of technological, financial and managerial capabilities of entities approved by the Resolution No O3-6 of the National Control Commission for Prices and Energy of 29 January 2009  "On the Approval of the Description of the Procedure of Assessment of Technological, Financial and Managerial Capabilities of Energy Companies".
